By placing an order for wine, you, as the “Buyer” warrant that you are at least 21 years of age, a person to whom wine may be lawfully sold, and that you will be responsible for ensuring the shipment of this wine is received by a person who is also at least 21 years of age. You further warrant that any wine ordered is for personal consumption and not for resale.
If wine is shipped to you, we will contract with a 3rd party carrier who will deliver the wine you purchased via the Eataly Vino website. Please be advised, ownership of any Wine that Eataly Vino sells by way of its website “changes hands” at the time of purchase, which for all intents and purpose occurs in the state of Illinois and subject to sales tax in that state. By requesting your wine be shipped to you, you are authorizing us to engage a common carrier on your behalf to deliver your wine. Eataly Vino is not responsible for any breakage or damage of wine by said common carrier.
If Eataly Vino, for any reason, is unable to fulfill its obligations to the Buyer, Eataly Vino’s sole obligation and the Buyer's sole recourse shall be a refund of the purchase price, including all taxes and shipping costs.
Eataly Vino makes no warranty, expressed or implied, about the wine being sold except that Eataly Vino is conveying clear title to the wine to Buyer and, that to Eataly Vino’s knowledge, the wine is what its label describes it to be. Specifically, because wine by its nature is subject to change in the bottle over time, Eataly Vino makes no warranty or guaranty of the quality or drinkability of any wine sold.
